CONTRAPOSIÇÕES ENTRE A DEMOCRACIA HABERMASIANA E A LIBERDADE DE EXPRESSÃO NO CONTEXTO DIGITAL
Abstract
The article aims to analyze the right to freedom of expression in digital environments as opposed to the democratic model of Habermas. This is a relevant approach, since the migration of discourses to the digital field and the lack of digital regulation have led to the notorious phenomenon of the massive dissemination of false news, potentially harmful to the autonomous formation of public opinion and the consequent decisions about sociopolitical topics, serving the deliberative democracy teory as a paradigm of heterogeneous and participative popular expression. Methodologically, the research is qualitative and analytical, with bibliographic and jurisprudential strategies. It is also relevant to highlight the weighting of the individual right of expression against the collective right to common well-being and the historical and biographical aspects of Habermas that guide and, to a certain extent, explain the theory of communicative action.
