A EFETIVIDADE DA TUTELA DO MEIO AMBIENTE URBANO E O DIREITO À CIDADE SUSTENTÁVEL

Abstract

Currently, the majority of the world's population resides in cities, and environmental, social and economic problems also occur intensely there, especially due to the lack of planning and the effectiveness of fundamental rights. From this delimitation, the object of this article is to investigate the effectiveness of the urban environment from the broad recognition of the fundamental right to a sustainable city. Therefore, the urban environment is characterized, the right to a sustainable city is analyzed from the constitutional foundations of environmental and urban policy. With the use of the inductive method and based on bibliographic research, it is concluded that there is a need for an adequate understanding of the right to the city based on the principle of sustainability and the constitutional principles governing environmental and urban policy.

Possui graduação em direito pela Universidade Estadual de Ponta Grossa (1998), mestrado em Ciências Jurídicas pela universidade do vale do Itajaí (2003); mestrado em Urbanismo, História e Arquitetura da Cidade (PGAU – cidade); doutorado em direito pela Universidade Federal de Santa Catarina (2005), Pós Doutorado em Direito Ambiental na Universidade Federal de Santa Catarina e Pós Doutorado em Direito Ambiental na Universidade de Alicante (Espanha). Foi juiz federal na 4ª Região (2001 a 2015), é professor no Doutorado e Mestrado em Ciência Jurídica e no Mestrado em Gestão de Políticas Públicas da Universidade do Vale do Itajaí; é professor da Escola Superior da Magistratura Federal de Santa Catarina; APAJUFE, Escola Superior da Magistratura Estadual de Santa Catarina e na Escola do Ministério Público em Santa Catarina.

Possui graduação em direito Universidade do Vale do Itajaí (2008), Pós-graduação em Direito Processual Civil, pela Universidade Anhanguera-UNIDERP (2012). Pós-graduação em Direito Civil Avançado, pela Universidade do Vale do Itajaí (2016), Mestrado em Ciências Jurídicas pela Universidade do Vale do Itajaí (2019), com dupla titulação no Master en Territorio Urbanismo y Sostenibilidad Ambiental en el Marco de da Economía Circular, na Universidade de Alicante (Espanha). Advogado.
