THE PROBLEM OF JUSTICE:

UM DIÁLOGO COM HANS KELSEN EM SUA APRESENTAÇÃO DAS NORMAS DE JUSTIÇA DO TIPO RACIONAL

Abstract

Hans Kelsen, in his book “The problem of justiceâ€, starting from his positivist theory, exposes part of his thinking on the theme, dividing the norms of justice into two types: rational and metaphysical. In order to better explain his understanding, he makes a list of several norms of justice that existed throughout history, presenting them from his point of view. The present work proposes a dialogue with Hans Kelsen offering other points of view for the understanding of the norms listed and exposed by him, seeking to share with other scholars of the subject, another view on the problem of justice.
