THE PROTECTION OF MIGRANTS IN THE INTER-AMERICAN SYSTEM OF HUMAN RIGHTS THROUGH JURISPRUDENTIAL ANALYSIS
Abstract
With migratory flow growing globally and being present in great intensity in American countries, this research aims to analyze the Inter-American System for the protection of Human Rights as a means of defending migrants, explaining the functions and competencies of the Inter-American Commission on Human Rights (IACHR) and the Inter-American Court of Human Rights (CoIDH). The research was carried out based on the deductive-exploratory method with bibliographical and jurisprudential research about the subject. Thus, to assimilate what is the situation faced by migrants in the American continent, the Court's jurisprudence will be exposed through the cases with contentious jurisdiction and its advisory jurisdiction, concluding with the position of the Inter-American System in the protection of human rights as regards to migration policies adopted by member countries of the Organization of American States.
