REGULAÇÃO DE AGROTÓXICOS NO BRASIL
O PROJETO DE LEI Nº 6.299/2002 SOB A ÉGIDE DO PRINCÃPIO DA PRECAUÇÃO
Abstract
The pesticides are widely used in Brazil and their legal regulation is given by Federal Law No. 7.802, of July 11, 1989. The National Congress proposed Bill 6,299 / 2002, which aims, among other things, to make rules governing the marketing and approval of such products in the country. Faced with this, there is an immense discussion about the possible legislative change, there being a dichotomy between proponents of this project, who aim at economic and social development with change, and those interested in blocking the measure, who seek to protect health and the environment , considering the significant risks that the banalization in the use of these chemicals can cause. In the present research, it is sought to analyze the relevance of this change to the Brazilian society, with theoretical support in the precautionary principle. It should be noted that the methodology of the present study is imminently bibliographical. Finally, it was concluded that prior to the effective adoption of the bill, a detailed analysis of the impacts that this will have on people's lives should be carried out, using the precautionary principle, proportionality and reasonableness, since there can be no if the subjects involved remain completely compromised due to the absence of prevention and risk reduction.
