O THE CONSTITUENT POWER AND THE REINTERPRETATION OF SPENDING LIMITS WITH PUBLIC EMPLOYEES

Abstract

This article analyzes the use of the secondary constituent power for reinterpretation of the limits of payments to public workers, according to the constitutional pattern. The focus is on Constitutional Amendment 54 of Goiás, which excluded from the limits, required by the Fiscal Responsibility Law, the payments to pensioners and the income tax withheld from workers. An analysis is made about the importance of that law to assure the fiscal balance and the limits established from the original constituent power. It demonstrates the impossibility of giving a new interpretation about the limits established in order to obtain the fiscal balance.
