O THE COLLECTIVE WRIT OF MANDAMUS AS AN INSTRUMENT TO GUARANTEE DIGNITY IN LABOR RELATIONS DURING THE PANDEMIC PERIOD

Abstract

The pandemic caused by the new coronavirus marks the peculiarity of the year 2020 that Brazil is experiencing. One of the recommendations of the world health organization is social distance, which invariably impacts on labor relations in different sectors of the economy. In order to alleviate the damage caused, several labor laws are being enacted under the argument of preserving workers' jobs and income, such as, for example, flexibilization by individual agreements, which has been increasingly accepted. In this sense, the present work defends the use of the collective writ of mandamus, filed by unions, to safeguard rights and protect, above all, the work environment and the rights of workers' personality, in the case of abuses of this apparent flexibility, to the detriment of workers. workers. The research is theoretical and the method is inductive, starting from particular questions for conclusions on the issue.
