Abstract

When it comes to information and communication technologies, the apparent bipolarity between public and private interests comes into play, and more specifically, the right to privacy. This dichotomy is no different when facing the new coronavirus in South Korea, a country that bases control on Big Data. However, the debate on the topic in a Far Eastern country must be free of orientalisms, and it is necessary to analyze it moving away from the concept of modernity and modern law. In this step, South Korean legal formation is examined through the imposition of Civil Law and Confucian ethical-political bases. The modern and the traditional come together in the understanding of the common good, democracy and privacy in South Korea, resulting in exceptions to the right to private life in the public interest and health. Thus, a strict personal data protection system is structured that allows limitations in cases of public health crises caused by contagious diseases. Faced with such problems, the objective is to contextualize the formation of the understanding of privacy and public interest in Korea and analyze the use of ICT in the prevention and combat of COVID-19, from its historical, ethical and legal bases. For this, the bibliographic methodology and the inductive method are used.
