Abstract

Chilean society has already faced various problems related to violence, derived from the idea of power and domination of a person or groups, causing physical, psychological, economic, or sexual damage. The present study aims to analyze two types of violence that have had normative consecration in Chile: sexual harassment and workplace harassment, from a normative and jurisprudential perspective. From the analysis of the rules in Chile, it is possible to conclude that the only applicable sanction is a fine for the offender, but nothing is said regarding the reparation of the damage that the conduct causes to the victim, that is, without a real and effective will to solve the underlying problem.

Professor and Researcher of the Master's Program in Law at the Salesian University Center of São Paulo (UNISAL). Assistant Professor at the Faculty of Engineering of Guaratinguetá (FEG/UNESP).
